Yes, New York is a no-fault divorce state. This means that a spouse does not have to prove fault or wrongdoing (such as adultery, abuse, or abandonment) to get a divorce. Instead, a divorce can be granted simply by stating that the marriage has irretrievably broken down for at least six months, which is one of the grounds for divorce under New York law.

Introduced in 2010, the no-fault divorce law in New York simplifies the process, allowing couples to divorce without the need to assign blame. One Is New York A No Fault State Divorce party must claim that the marriage has been broken for at least six months and that there are no unresolved issues regarding child custody, child support, or property division. If these issues are contested, the divorce process may take longer.
